Moenga Consulting is an independent AI operations consulting practice founded by Alex Moenga Mogaka, based in Nairobi, Kenya. Contact: hello@moengaconsulting.com.
We do not sell personal data. We share it only with the processors required to run the practice: our email provider (Google Workspace), our forms/CRM backend (Firebase), our newsletter sender, and our hosting provider (Cloudflare Pages). Each is under written data-processing terms.
You have the right to access, correct, delete, restrict or object to processing of your personal data, and to data portability. Email hello@moengaconsulting.com and we will respond within 30 days.
You have the right to complain to the Office of the Data Protection Commissioner (odpc.go.ke) if you believe we have mishandled your data.
We use Cloudflare Web Analytics, which does not require cookies and does not track across sites. We do not use advertising or marketing cookies. If this changes, we will show a cookie banner.

Standard terms that apply to Moenga Consulting engagements, in addition to the specific scope and fee set out in each proposal.
Each engagement is governed by a written proposal that sets out deliverables, timeline, dependencies and a fixed fee. Changes to scope are agreed in writing and quoted separately.
Build engagements: 50% on signature of the proposal, 50% on handover. Retainers: monthly in advance. Invoices are payable within 14 days of issue. Late payment attracts 1.5% per month on the outstanding balance.
You own the deliverables prepared specifically for you (dashboards, data models, documentation, reports). Moenga Consulting retains ownership of its underlying methods, templates and tooling, and may reuse them on other engagements. Nothing in this clause transfers ownership of your data or your pre-existing IP.
We treat all client information as confidential. We will not disclose, name or describe your institution publicly without written consent. We may describe anonymised engagement outcomes (hours saved, error reduction) in marketing material, with no identifying details, unless you ask us not to.
We handle your data under the Moenga Consulting data-handling statement, which forms part of each engagement. Specifically: anonymisation before analysis where possible, access control, deletion at handover, no client data in public AI tools.
Our total aggregate liability under any engagement is capped at the fees paid for that engagement. We are not liable for indirect, consequential or special losses. Nothing in this clause excludes liability that cannot be excluded by law.
Either party may terminate for material breach not remedied within 14 days of written notice. On termination, fees are payable pro-rata for work completed and accepted.
The parties will attempt to resolve disputes amicably within 30 days. If not resolved, disputes are referred to arbitration under the Chartered Institute of Arbitrators (Kenya Branch) rules, seat Nairobi, in English.
These terms and each engagement are governed by the laws of Kenya.
How Moenga Consulting handles your institution’s data during an engagement. Forms part of every engagement by reference.
Data you share with us remains your property. We act as a data processor on your behalf under written terms. We do not sell, licence or share your data with third parties.
Where the analysis does not require identifiers — and most does not — we anonymise your data before processing. Member names, national IDs, phone numbers and account numbers are hashed or removed. The engagement proposal names the fields involved explicitly.
Access is restricted to the specific individuals delivering the engagement. We use multi-factor authentication, device encryption and least-privilege access. We maintain a written access log for the engagement.
At engagement handover, we delete your working data from our systems and provide written confirmation. We retain only what is required under our professional record-keeping obligations and our terms of engagement.
We do not paste client data into public AI tools (ChatGPT, Claude free-tier, Gemini, etc.). Where we use AI during an engagement, it is on anonymised data only, through enterprise tiers with a signed data-processing addendum, and recorded in a written AI usage log.
We use the following sub-processors to deliver the practice: Google Workspace (email, documents), Firebase (website backend), Cloudflare Pages (website hosting). Each is under a data-processing addendum. We will notify you if we add a sub-processor that processes your engagement data.
If we become aware of a personal-data breach involving your data, we will notify you in writing within 72 hours of discovery, with the facts available at that time, and update you as the investigation proceeds.
We can accept your institution’s standard data-processing or data-sharing addendum, and will negotiate reasonable amendments. Where you do not have one, we provide our own as part of the engagement proposal.
Because selling reconciliation and controls to regulated institutions without a public data-handling statement is self-contradicting. This document is the floor; the specific engagement proposal sets anything stricter that applies to your work.
